Administrative License Suspension
The New Hampshire Department of Safety will take action to suspend your driver’s license or driving privileges within thirty (30) days of the arrest. You must request a hearing on your suspension within that 30-day time frame or you will remain under suspension.
*Note – you will go under suspension after the 30-day time frame, regardless of whether or not you request a hearing. Requesting a hearing does not stay the suspension.
If it is a first offense DWI (.02% or more for an underage driver), the penalty is for six (6) months pursuant to RSA 265-A:30.
If a person has a prior DWI ALS or conviction, the suspension shall be for two (2) years, pursuant to RSA 265-A:30.
If a person refuses to submit to a breath test, the suspension shall be for six (6) months and may not run concurrently with any penalties imposed by the court.
